Privacy Policy

The Decor Corporation Pty Ltd (ACN 004 231 109) (“Decor“) is committed to protecting your privacy. This Privacy Policy details how Decor complies with the Privacy Act 1988 (Cth) (“Privacy Act”), the Australian Privacy Principles (“APPs”), and the EU General Data Protection Regulation 2016/679 (“GDPR”).

This Privacy Policy describes how Decor handles information you provide to Decor, whether that be in person, by phone, over email, or through Decor’s website located at www.decor.com.au (the “Website”). Decor may modify its Privacy Policy from time to time and if it does so, it will post any updated Privacy Policy on the Website. Any variations become effective on posting the updated Privacy Policy and Decor shall have no obligation to provide you with individual notice of such changes. Decor encourages you to check the Website periodically to ensure that you are aware of our current Privacy Policy, as your continued use of Decor’s services following the publication on any amended Privacy Policy shall signify your acceptance of the amended Privacy Policy.

Information Decor collects
This Privacy Policy covers all information collected by Decor when you engage with Decor’s products and services. The information Decor collects can be broken down into the following types:

  • “Personal Information” means information that can be used to personally identify you such as your name, residential address, email address, contact number and payment details. We will not intentionally collect or process the Personal Information of anyone under the age of 18 without the express consent of their parent or guardian.
  • “Usage Information” means anonymous aggregate data that is automatically collected through your use of our Website. This includes information that identifies your device, your operating system, your IP address and dates and times that you access and use the Website. This information is used for statistical analysis to help Decor improve their services to the benefit of all users.
  • “Personal Data” means your Personal Information, as well as any Usage Information that, whilst for the most part anonymous, can be cumulatively used to directly or indirectly identify you.
  • “Sensitive Information” such as information about your health, race, religion, philosophical beliefs, political opinions, memberships of political, trade or professional associations, criminal record or sexual orientation, is not collected by Decor, and Decor requests that you do not disclose this information when dealing with Decor.

How Decor collects Personal Data
Decor collects the Personal Data it needs to operate its business, including to provide products, services, and information to customers. If you choose not to provide your Personal Data, Decor may not be able to provide you with the services you require. Decor generally collects your Personal Data directly from you. However, Decor may collect information about you from other people as described below.

When you use the Website
When you use the Website, you may choose to provide your name, email address or other contact details in order for Decor to contact you.

When you make an enquiry
You may also choose to provide Décor with your name or other contact details when you call Decor by phone, or write to Decor about Decor products and services.

When you purchase our products

When you order products, Decor may collect information from you in order to process your order, such as your name, business address, phone number, email address, billing information and credit card number.

When you opt in to receive Direct Marketing Communications
You may opt in to receive our newsletters and other information via the Website or other methods. Decor recognises your right under the Spam Act 2003 (Cth) to opt out from direct marketing communications, and as such these consents can be modified at any time by contacting our Privacy Officer per the contact details at the end of the Privacy Policy, or by clicking ‘unsubscribe’ on any direct marketing communications. Please note certain non-marketing related correspondence from Decor, including messages relating to payment, will be automatically sent to you by virtue of your use of the Website and associated services, and you may not have the option to unsubscribe from receiving this correspondence.

As part of our general business operations
Decor also collects Personal Data about individuals who are, or are employed by, our suppliers (including service and content providers), contractors, related companies, agents and corporate customers. This information may include an individual’s name, contact details, and other information necessary for Decor to conduct business or maintain an employment relationship.

Employees and contractors

When you apply for a job or contract with Decor, Decor may collect information about you, including your name, contact details, information about your working history and information from relevant reference checks. Decor may collect this information from you as well as from any recruitment consultant, your previous employers, and others who may be able to provide information to us to assist Decor in their decision on whether or not to make you an offer of employment or engage you under a contract. This Privacy Policy does not apply to acts and practices in relation to employee records of Decor’s current and former employees where those acts or practices are exempt from the Privacy Act.

How does Decor use personal information?
Decor generally collects and processes your Personal Data for the purposes for which it was collected and for related purposes that would be reasonably expected by you (or otherwise as required or authorised by law).

Legitimate business purposes that Decor uses your Personal Data for includes:

  • to conduct Decor’s business and provide you with Decor’s products and services;
  • to help Decor carry out market and product analysis so that Decor can continue to deliver enhanced services and products;
  • to contact you, including with promotional materials and notifications where you have opted in to receive such direct marketing;
  • for billing and account management;
  • to process applications for jobs or contracts with Decor, including performing reference checks;
  • for the purposes of fraud prevention; and
  • to investigate or take action in response to illegal activities; fraud or technical or security issues; or threats against the rights, property or safety of Decor.

Disclosing personal information
For the purposes described above, Decor may disclose your Personal Data:

  • to their suppliers (including service and content providers), contractors, related companies and agents;
  • to government agencies or regulatory bodies responsible for the investigation and resolution of disputes or complaints concerning your use of Decor’s services and products;
  • to anyone to whom Decor’s assets or business (or any part of it) is transferred or sold;
  • where you have otherwise consented; or
  • as otherwise required or authorised by law.

Decor will take reasonable steps to ensure that the persons and organisations to whom Decor discloses your Personal Data are bound to protect the privacy of that Personal Data. Decor will not sell or otherwise provide your Personal Data to a third party, or make any other use of your Personal Data for any purpose which is not incidental to your use of Decor’s products or services (including the Website). For the avoidance of doubt, Personal Data will not be used for any purpose which a reasonable person in your position would not expect.

Cookies and IP address tracking
The Website may use cookies for site administration purposes. If for any reason you wish not to take advantage of cookies, you may disable them in your browser, although this may impact your ability to use some of the features of the Website.

The Website may also detect and use your IP address or domain name for internal traffic monitoring and capacity purposes, or to otherwise administer the Website.

The Website also uses a number of third party platforms and sites through API’s, plugins and links to enhance your user experience. Please note that this Privacy Policy does not cover the privacy practices of third party platforms and sites which may be integrated or otherwise linked to the Website. Decor does not have access to, or control over, the technologies that these third parties may use to collect information about you. Decor disclaims all liability in connection with the services of these third party platforms and sites. If you have any concerns about third party platforms and sites integrated or otherwise linked to the Website, Decor encourages you to reach out to them directly via the links supplied above.

How secure is your personal information?
Decor regards the security of your Personal Data as a priority and has implemented a number of physical and electronic measures to protect it. Decor reminds you, however, that although all care is taken, there are inherent risks with transferring data over the internet and storing data electronically. Decor cannot guarantee the security of your information and, to the extent permitted by law, Decor accepts no liability for any breach of security, or direct hacking of our security measures, or any unintentional disclosure, loss or misuse of any information or data or for the actions of any third parties that may obtain any information or data.

Notwithstanding the above, Decor acknowledges their obligation to report any data breach that is likely to risk the rights and freedoms of natural persons to the Australian Information Commissioner and, where a data breach involves the information of EU subjects, report to the European Data Protection Supervisor. Decor will also inform you, where possible, if your data has been breached in the circumstance where it poses a risk of serious harm or your rights and freedoms.

Decor also trains all staff who may have access to your Personal Data about this Privacy Policy and our obligations under the Privacy Act, APPs, and GDPR.

Decor may, in the course of their business operations, transfer your Personal Data to overseas countries that are deemed by the EU Commission as having an ‘adequate’ level of Personal Data protection. Where Decor transfers data to a third party in a country where no adequacy decision has been made, Decor will use all reasonable endeavours to ensure that any person or entity handling your data in those countries are bound under contract to meet the requirements of the Privacy Act, APPs and GDPR.

Access and correction
You have the right to access any Personal Data that Decor holds about you. In some circumstances it may not be possible for Decor to provide you with access to all of the Personal Data held about you. Decor will notify you if it will not be possible for Decor to provide you with access to your Personal Data, or where a valid exception applies under law. When you request access, Decor may need to take measures to verify your identity.

You acknowledge that it is your responsibility to maintain the truth, accuracy, and completeness of your information and your failure to do so may inhibit Decor’s ability to provide their products and services. If you think that any Personal Information Decor holds about you is not accurate, complete or up-to-date, you have the right to request that Decor correct that information, and Decor will take reasonable steps to ensure that the information is corrected.

In accordance with the GDPR, Decor additionally acknowledges the specific rights of EU subjects to:

  • have their data erased that is no longer being used for a legitimate purpose;
  • request a copy of all Personal Data held about them by Decor in a readable format; and
  • request restricted processing of their Personal Data whilst any complaints or concerns are being resolved.
